Remove Hypothecation (Bank Loan) from RC: the complete guide
When you buy a vehicle on a loan, the lender’s name is printed on your Registration Certificate (RC). Paying the last EMI does not remove it automatically. This guide explains how to get the bank’s name taken off your RC after the loan is closed, using Form 35 and the lender’s NOC on the Vahan portal.
Who needs this
Anyone whose RC still shows “hypothecated to” a bank or finance company after the loan has been repaid. Removing it matters because:
- You cannot sell the vehicle smoothly while the bank is noted on the RC.
- Insurance claims for total loss or theft may be paid to the bank instead of you.
- Some RTO services, such as a duplicate RC or an address change, need the bank’s consent until the entry is removed.
Hypothecation removal is a nationwide service under the Motor Vehicles Act, but it is handled by your state RTO, so documents can vary a little.
Documents explained
Form 35. This is the notice that the hire-purchase, lease or hypothecation agreement has ended. It has a part for you and a part for the bank. Lenders usually hand over two signed copies with the NOC.
Loan closure NOC. A letter from the lender confirming the loan is fully paid and that it has no objection to removing its name. Check that the registration number, engine number and chassis number exactly match your RC. Many RTOs treat the NOC as valid for about three months, so apply soon after you receive it.
Original RC. Needed so the RTO can issue a fresh RC without the bank’s name.
Insurance and PUC. Both should be valid. After the RTO update, ask your insurer to remove the bank from the policy as well.
ID and address proof. Only needed if you are not using Aadhaar eKYC, or if your RTO asks.
Step-by-step process
- Collect papers from the lender. After the final EMI, request the NOC and Form 35. Some lenders send them by post; others ask you to collect them from a branch.
- Check the NOC date. If it is older than three months, ask for a revalidated letter.
- Open Vahan. Go to the Vahan citizen services portal, enter your registration number and pick Hypothecation Termination.
- Choose contactless if you can. If your Aadhaar and the mobile number on the RC are in order, you can apply with Aadhaar OTP and upload the documents without visiting the RTO.
- Pay the fee. The amount shown on Vahan includes any smart card and postage charges your state adds.
- Submit originals if needed. For non-contactless applications, print the receipt and take the RC, NOC and Form 35 to the RTO.
- Receive the new RC. Track the status online. The new RC is posted to you and the e-RC in DigiLocker updates.
Fees and timelines
Rule 81 of the Central Motor Vehicles Rules lists a fee for hypothecation entries: ₹500 for a two-wheeler, ₹1,500 for a car or other light vehicle and ₹3,000 for medium and heavy vehicles. Some state fee tables show no separate charge for removing the entry, so the actual amount depends on your state. Add ₹200 for a smart card RC plus postal charges. Expect the new RC within one to three weeks after the RTO accepts the application.
Common problems and fixes
- NOC details don’t match the RC. Even one wrong digit in the chassis number leads to rejection. Ask the lender to correct and reissue the letter.
- Lender has merged or closed. Contact the bank that took over the loan book; it can issue the NOC on its own letterhead.
- OTP not received. The OTP goes to the mobile number on the vehicle record. Update the number on Vahan first, or choose the RTO-visit route.
- Application stuck “pending at RTO”. Visit the RTO with the application number. Some offices verify the NOC with the bank before approving.
Frequently asked questions
Does the bank remove hypothecation itself?
Usually not. Some lenders now update the loan closure electronically on Vahan, but most leave it to the owner to apply (verify with your lender).
Can I sell the car before removing hypothecation?
Yes, but the buyer’s transfer will need the bank’s NOC or signature on Form 30. It is simpler to remove hypothecation first.
Do I need to remove the bank’s name from my insurance too?
Yes. Send the updated RC to your insurer so that future claims are paid to you.
Is there a deadline after loan closure?
There is no strict legal deadline for the owner, but NOCs go stale, so apply within a few weeks.
